Our family law solicitor can advise you on all elements of your separation including divorce and arrangements for your children. We can also advise you where social services are involved with the children and what can happen if a child needs to live somewhere other than with their parents.

Care Proceedings
Care proceedings are court proceedings initiated by the local authority‘s children’s services department in which an application for a care order or supervision order in relation to a child is made. If children’s services believe a child is suffering significant harm or at risk of suffering significant harm, they can apply to court for permission to take action to protect the child.
Legal aid is available on a non-means, non-merits tested basis in care proceedings where it is available for the child who is the subject of the proceedings and the parents of or parties with parental responsibility for the subject child. This means that regardless of a person’s income, they are eligible.
Private Law Proceedings
In respect of divorce and matters concerning the arrangements for the children after the parties have separated you may be eligible for legal aid if you have been a victim of domestic abuse or your child is at risk of abuse. The evidence must show that you are or are at risk of being a victim of domestic abuse or violence from the other party in the case arising from a family relationship between you and the other party.

If you believe your children is at risk of abuse the evidence must show that you are seeking to protect a child from the risk of abuse from the other party in the proceedings. This may be in relation to another child.
